HELLO well not a really good day for me today i was driving to the shops and got pulled over by the cops just a rutene check after checking my licence and fining me for no P plates they let me go drive down cuople of blocks they caught up to me and pulled me over again they told me that my licence has been suspended since september which i neva had aby notice bout it they also told me that if this was my second time then i cuold face prison which i have been caught driving while suspended bout 2yrs ago is that wat the officer ment as in suspended in ur whole life and getting caught twice or did he mean getting booked for that suspended licence then getting caught the second time with that same suspension. now i have to go court soon and dont know wat the'll do to me:( just brought the car and now wont b able to drive it to work no more and most proble have to quit my job since i work late shift at crown:(:(:(:( i just wanna scream. and its not like i was speeding all my deremit points was lost cost of no P plates which this is the 3rd time that happened i dont know y u can loose points for not putting P plates how can u kill or kill urself from not putting them on the LAW is so weird. should just b a fine or just 1 point lost i bloosy lost 3 points for just that and found out got done 3 times in the past so thats 9 points i think thats to much points for not displaying it. SO HAS ANY1 GOT A SAY IN THIS? b4dn x :(

| No offence and you probs dont wanna hear this, but you broke the law(the same one 3 times none the less) and got caught, you pay the consequences... And what is the big deal with having P plates up, all u have to do is stick them there and leave them..no biggie! Do the crime do the time, next time you hopefully wont make the same mistakes. |

| its your second offence my understanding is that there could be a possibility of a 3 month jail term. though if you honestly did not know you were suspended then you can plead that in your case. i think u may need a representation |

| i didnt get no notification bout tht no mail so how am i supposed ta know my licence was suspended wen i b4 today i had heaps of police pull me over and they didnt ssay anything bout it so how am i supposed ta know and to joogie i didnt put this post in for ****en negative replys hehe plusi mite meet som good looking gurls in ther i hope lol b4dn x |

| Its nothing to do with being a girl... its the law, same for every person. You broke it, you deal with it. And if you didnt expect negative replies after admitting to breaking the same law 3 times well... It sucks you lost your license for such a small thing but hey your a P plater, we always get picked on. |

| sweet u have nothing 2 worrie about ... go to court and plead your case ... as long as u dont have a realy sh1tty driving record IE like mine ;) u should b right ... but in saying this u did break the law and well.. Somtimes a wake up call is in order!!! But as 4 going to jail this time ,I dont think u will just a hefty fine and court suspension and make sure if u under court sus that u dont drive cause if u get caught again u will get locked up ... Trust me I know! |

| Yeah i agree with trizo i dont think your going to jail, to much paper work for the lazy cops and court system. Have you heard anything more? and at least if you cant drive your car its a good excuse to save money and do it up ;) |

While you may not have started this thread to hear 'negative' replies, what they have said is true...you broke the law.
Despite what you think of the law, it is none the less the law (I'm refering to the P-plate issue here). You are required to display them front and rear of the vehicle while you are on a probationary licence, failure to do so leads to a maximum penalty of 3 months licence suspension. You do not have to agree with the law, you just have to abide by it. If you broke the law, and it seems that you have, you should be prepared to pay the penalty. I got done for it once (after the one at the rear fell off) and got a $100 fine for it.
Having been booked for it previously you were well aware of your responsibility to display P-plates. Also, since you have been booked for it before, you cannot plead ignorance and hope to get away with it. (BTW: Ignorance of the road laws is NOT an acceptable defense in a court of law)
Something else that's worth noting is that the current incarnation of the Road Safety Laws states that if, in any contiguous 12 month period a driver on a probationary licence looses 5 or more demerit points their licence can be suspended or cancelled for a period of 3 months. This is as well as the standard amount of 12 points and you're gone.
All that said, I doubt you'd go to jail for this, you may end up with a very large monetary fine. If you had been speeding, through a red light while drunk and talking on your mobile phone then I dare say you'd end up in jail, but since you were not driving in a wreckless way I can't see you ending up in jail.

| oh ok cool that just put less weight to my chest.lol but the officer that pulled me over said the next time i get my licence bak would be augest is he lying? if its 3 months wouldnt it be till june? if so then a fine and no jail time and my licence bak in june cuoldnt get any better like trizo said now i can save up money aswell but probly have to quit my job or pretend im on holidays cos i aint walking from thee city to noblepark at 4am in the morning |

| sorry 2 say this but yep.. the way the law is with driving and the current road deaths, there taking a fairly tough stance.( which in my opinion is good) it might make people wake up a bit a relise that driving is not a game!!!!! It's a sh1t of a way 2 learn but like the judge told me when he sentanced me 4 repeat traffic offences ,,, mr suchn such youve made your bed lye in it!!! |

| It could be that because this is a repeat offence, or even a combination of offences that the time is a bit longer than 3 months. |

The first time i lost my licence on my P's i lost it for six months. It depends on the offence. For example the one single offence i lost my licence on carried a penalty of 6 points. Im 7 days off getting my licence back and i have not driven unlicenced since they took it.
Sweet it isnt always easy for you to do the right thing but its alot harder facing the consequences when you do. You may just have to take what you get with this one, here is hoping you get a judge that is having a good day. Or atleast admit that you were at fault and that what you did was a stupid thing it could work to your advantage. |

| m8 I wouldnt worrie about it cop it on the chin u did the wrong thing .. the judge always takes in to consideration a guilty plea and any remorse ect.. u havnt killed or robbed any1 , so I wouldn't worrie just be more carful next time! ;) |

| lol trizo i would be guilty if i knew that i had a suspended licence like i told u guyz b4 the last police officer that pulled me over i had others that pulled me over and they neva notified that i had a suspended licence so i neva knew so i kept on driving. so am i guilt or not??????????b4dn |

yeah guilty! just go 2 court and plead guilty, its not the officer's job (as much as I dont likem) 2 tell u if your licence is suspended! This is somthing you should know !!
m8 your definitly guilty 4 the fact you were charged and it sez that your licence is suspended on the computer... so as far as the law goes u dont have a legal leg to stand on .. u can always plead a bit of ingnorance but I think som1 already mentioned dont bother !Get your fine save your penny's and start being a good girl! ;) |

Speak to a lawyer so you've atleast got some idea whats going on.
Bottom line- you screwed up by driving suspended, but a lawyer may be able to lessen any punishment (plea of guilty or not). |

| yh i have spoken to my solicetor and she said that i should plead guilty she also said that 2 offence for un licence driving is a big problem cos its a serious offence in victoria. she said if i was driving without eva having a licence i would just get a fine but suspended while driving is harsher than no licence driving. how weird is the law these days. b4dn xxxx |

The fact that they let you stay in your car, they see you drive off after giving you a fine for no "P" plate with out saying that your license is suspended, and I gather that they followed you for the couple of blocks and then pull you over again and tell you then could have some bearing on the case.
For a start, they can not get you for having no "P" plate if they want to proceed with the suspended license, because basically you was un-licensed at the time. They should not of issued you with that fine if they had checked correctly, like they should of. It would of been a straight "Driving while disqualified" offence. Check with your lawyer, and I am sure if she does her job correctly, she will find out that they can not do both.
Might be a small chance of having the penalty imposed for driving while disqalified reduced, as if the police did not know when they first pulled you over about your license, then you may not of been notified correctly that you was driving while disqualified and thus, un-aware..

Well worth a shot. If nothing else the Police may not press the matter because they'd end up looking stuipd.

After I sent the ANZ Banking Group Ltd the e-mail I did, I never heard a peep out of them, so yes, I still have www.anz-banking.com
